The Supreme Court has asked for help from Attorney General R Venkataramani to make a decision about a request. This request is about fixing a time limit for the government to announce the names of judges that the highest court’s collegium has recommended for appointment.
This request was discussed on a Friday in front of a group of judges led by Chief Justice D Y Chandrachud, along with Justices J B Pardiwala and Manoj Misra.
The group of judges said, “Give a copy of the request to the office of the Attorney General for India. We are asking the Attorney General to assist the court,” and they have planned to talk about it again on September 8.
The request was made by a lawyer named Harsh Vibhore Singhal.
In this request, the lawyer explained, “This request does not challenge the way the Supreme Court Collegium (SCC) chooses judges. Instead, it wants to make the SCC stronger to protect the freedom of judges.”
The request wants to solve a problem. Right now, there is no set time for the government to tell everyone about the names of the judges that the collegium has chosen for important positions in the higher courts.
The request argues that without a set time, the government can “unfairly wait to tell everyone about the new judges. This is a problem because it takes away the freedom of the judges and makes the court less important.”
“It’s important for the court to set a clear time under Article 142 of the Constitution. This will let the government say if they have a problem with a judge that the collegium chose. And it will also make sure that everyone knows about new judges on time.”
Article 142 of the Constitution is about making sure that the highest court’s orders are followed so that justice is done. According to Article 142(1), the highest court’s orders are followed in all of India.
The request also says that if nobody has a problem with a judge or if the government doesn’t tell everyone about new judges in the set time, then everyone should consider those judges as chosen.
